The legality of the Endowment
Endowment is legal and welcomed, and the Quran verses and the sayings of the Prophet, peace be upon him, have shown the evidence:
Allah Almighty says: (By no means shall ye attain righteousness unless ye give (freely) of that which ye love), and as Abu Talha heard this, may Allah please him, he took the initiative to endow the best of his property, which is a great palm grove named (Bayruhaa').
According to Al Mustafa (the Prophet) peace be upon him: "If the son of Adam dies, his work stops except for three: ongoing charity, or a useful science, or a good son who prays for him", and according to scholars, on-going charity is as endowment, the other handouts are not ongoing, but the alms taker can utilize and own it.
Ibin Omar, may Allah please him, narrated: that Omar owned a land in Khyber, said: "O Messenger of Allah: I've had a property in Khyber, I had never anything more precious, and so what do you order me to do? The prophet answered:« You are allowed to endow it or give it as charity , but its origin is not sold or purchased, not granted or inherited to the poor, and relatives and slaves and guest and traveler, and no harm if the alms taker eats from it and feeds others(narrated by the collection of scholars).
Othman, may Allah please him, says that the Prophet, peace be upon him, paid a visit to Medina which had no drinking water except the well of Roomah. The Prophet said: «Who buys the well of Roomah and puts his bucket with buckets of Muslims will have (something) better in heaven». Then I (Othman) purchased it with my own money. (Narrated by Al Nisaiy Al-Tirmidhi, a good saying).
What is stated in the verse and prophet sayings is apparent legality of the endowment and Prophet Muhammad, bless and peace be upon him, encouragement and urging his companions to do so.
